Boating Under the Influence in San Diego County, CA
The city of San Diego is close to lakes and the Pacific Ocean, and many residents take frequently take advantage of this to partake in recreational boating or water sports. Just as it is illegal to drive a motor vehicle (car, truck, motorcycle, etc) while under the influence of alcohol or a controlled substance, it is also illegal to operate a boat or other watercraft while with a blood alcohol concentration of .08%. Boating under the influence (BUI) is a serious criminal offense that can result in much the same penalties as driving under the influence (DUI), including imprisonment, fines, probation, and community service.

About BUI in San Diego
Although some of the laws and penalties regarding boating under the influence and driving under the influence are similar, there are particular differences that should be addressed:
- You can have an open container of alcohol in the cabin of a boat, unlike in a vehicle
- You can drink alcohol in the cabin of a boat, but not in a vehicle
The only watercrafts that are subject to California BUI law are those with motors. Kayaks, canoes or other watercraft which are not motorized are not governed by BUI laws. You can be charged with boating under the influence if you are in a boat or other watercraft that is being towed by another boat, such as if you are waterskiing and have a blood alcohol concentration that is above the legal limit.
Working with a San Diego BUI attorney may be your only chance of avoiding a criminal conviction and serious penalties for boating under the influence.
