As a driver in San Diego, if you are pulled over and arrested for drunk driving the process may go as follows (the particular circumstances may vary depending on your particular arrest):
- A police officer observes a driver who has disobeyed a traffic law or is otherwise driving in an erratic or dangerous manner that may indicate intoxication.
- The officer pulls the driver over to the side of the road and asks him or her for license and registration information. At this time, the driver will also take note of any indicators that may show the driver is under the influence of alcohol or drugs, such as slurred speech, bloodshot eyes or open alcohol containers in the vehicle.
- Depending on the officer's initial assessment of the driver, he or she may ask the driver to step out of the vehicle to perform field sobriety tests. These tests gauge a driver's balance, coordination and ability to follow instructions and are considered to show whether a driver's mental and/or physical abilities are impaired by alcohol or drugs.
- The driver's performance on field sobriety tests, any comments he or she makes and the officer's observations will all be taken into account when the officer decides whether to make an arrest for DUI.
- After the driver is arrested, he or she will be taken to the police station, where law enforcement will request that he or she submit to a chemical test (blood or breath test) to determine his or her blood alcohol concentration.
